Based on his years of experience at the IRS and now in the private sector, Mike will be giving a presentation entitled How to Avoid and What to Do If Audited by the IRS.  This will focus on estate and gift tax returns.  Mike will introduce the structure of the IRS as it relates to these types of returns. Following that introduction insights will provided on what to do before the return is filed, steps to take given the IRS classification processes, steps to take on audit, and what to do if the case is unagreed and proceeds to Appeals or litigation.

From Mike’s commentary on How to Work with IRS: Second Edition (June 2014), and after an overview of how the IRS is organized into 13 different business units, concentrated commentary is presented regarding these issues in the  Large  Business and International Division (LB&I) (assets over $10M) and the Small Business Self Employed Division (SBSE) (assets $10M and less).  As an example the estate and gift classification process is followed from start to finish to provide insight.  Issue resolution at the IRS is division dependent.

This session includes a full day of CPE addressing four  specific areas. The first three areas address Discounts for Lack of Marketability (DLOM) and the IRS, reasonable compensation determinations by the IRS, and valuing S-Corp non-controlling interest by the IRS being presented by the original IRS issue champion on these issues.  Participants will learn how the IRS approaches each of these issues and what you can do when addressing these issues with your cases  Having addressed these three technical topics the fourth session will addres on How to  Work with the IRS.
